Terms of Service
David Carreras Castañ (hereinafter, "the Controller") manages the website www.pack-spot.com (hereinafter, "the Web"), which offers a mobile application subscription plan available in the Play Store and Apple Store, as well as the sale of physical devices related to said application. These Terms of Service regulate the use of the Web and the contracting conditions of the Products and Services offered.
By accessing the Web, using the Services, or making a purchase, you (hereinafter, "the Client") expressly and fully accept the conditions set forth in this document. If you do not agree with these conditions, you must not use the Web or acquire the Products or Services.

2. Purpose
These Terms of Service set forth the conditions regulating:
- Access and use of the Web.
- Contracting subscription plans for the mobile application.
- The purchase of physical devices related to the application.
- The rights and obligations of the Controller and the Client.
3. Conditions of access and use of the Web
- Free access: Browsing the Web is free, except for Internet connection costs.
- Permitted use: The Client undertakes to use the Web in a lawful manner, refraining from activities that may damage the Web, the Services, or third parties.
- Restrictions: It is forbidden to reproduce, distribute, modify, or exploit the contents of the Web without the express authorization of the Controller.
4. Contracting Process
4.1. Purchase of physical devices
- Essential operating condition: The acquired physical device strictly requires an active subscription to one of our service plans for its correct operation.
- Once the payment is processed, the Client will receive an email confirming the order, including the order number, product details, and estimated delivery time.
- The devices will be sent to the address provided by the Client within 3-5 business days.
4.2. Mobile application subscription
- The subscription payment is processed exclusively through Shopify.
- Once the payment is confirmed, the subscription is activated immediately.
- The Client will receive a confirmation email with full details of the subscription.
4.3. Prices
- Prices are shown in euros (€) and include the applicable VAT in Spain.
- The Controller reserves the right to modify prices at any time, but changes will not affect already confirmed orders.
5. Payment Methods
The Client can pay by credit or debit card, PayPal, Stripe, or other secure payment gateways. The Controller does not store payment card data.
6. Delivery of physical devices
- Delivery time: Devices will be shipped within 3-5 business days from order confirmation.
- Delivery location: Shipments will be made to the address provided by the Client, within mainland Spain territory.
- Responsibility: The risk of loss or damage of the product is transferred to the Client at the time of delivery.
7. Right of withdrawal
7.1. Physical devices
In accordance with Article 103 of Royal Legislative Decree 1/2007, the right of withdrawal does not apply when contracting between companies (B2B relationship) and the customer acts within their business or professional activity.
7.2. Digital subscriptions
In accordance with Article 103.m) of Royal Legislative Decree 1/2007, the right of withdrawal does not apply to digital subscriptions once the service has started.
8. Commercial Warranty
8.1. Physical devices in B2B contracting
A voluntary commercial warranty of 12 months from the delivery date is established. This warranty covers manufacturing and operating defects that prevent normal use of the product.
8.2. Claim procedure
To make the warranty effective, the Client must notify in writing the detected defects within a maximum period of 15 days from discovery.
9. Cancellation and refunds of subscriptions
9.1. Subscription management
Subscriptions are managed exclusively through the Shopify platform.
9.2. Cancellation by the Client
The Client can cancel their subscription at any time. Cancellation will take effect at the end of the current billing period.
9.3. Refund policy
No refunds will be made for partial periods once the billing cycle has started, unless required by applicable law.
9.4. Suspension for non-payment
Non-payment of the subscription will result in the immediate suspension of the service.
10. Obligations of the Client
The Client undertakes to provide true and complete data, use the Products and Services lawfully, not conduct fraudulent or illegal uses, and pay the amounts corresponding to the acquired Products.
11. Liability of the Controller
The Controller undertakes to provide the Products and Services in accordance with the descriptions on the Web, comply with legal guarantees and delivery times, and protect the Client's personal data. The Controller is not liable for delays caused by third parties or force majeure, or for damage caused by misuse of devices.
12. Intellectual and Industrial Property
All contents of the Web and the application are property of the Controller or authorized third parties. Their reproduction, distribution, or modification without express authorization is prohibited.
13. Data Protection
The Client's personal data will be processed in accordance with the GDPR and Organic Law 3/2018. For more information, see the Privacy Policy.
14. Modifications
The Controller reserves the right to modify these Terms of Service. The modifications will be published on the Web with the date of update.
15. Applicable legislation and jurisdiction
These Terms of Service are governed by Spanish legislation. For any controversy, the parties will submit to the Courts and Tribunals of Fraga, Spain.
